Terms of service
The agreement between you and MyHero. Short sections, plain words, and the same rules for everyone from the free plan up.
1. The agreement
These terms are a contract between you and Thumpy Marketing, Vancouver, British Columbia, which operates MyHero ("MyHero", "we"). You accept them by signing in or by using the service. If you use MyHero for a brokerage or company, you confirm you may bind it, and "you" includes it.
2. Who can use it
You must be at least 19 and using MyHero for a real-estate business: a licensed realtor, a member of their team, a developer's sales team, or someone working on their behalf. MyHero is not for consumers and not for collecting information about people who have not asked to be contacted.
3. Your account
You sign in with Google, Apple, or a code we email you. Keep your sign-in to yourself; you are responsible for what happens in your account. Tell us at once at hello@myherohq.com if you think someone else has access. On Basic, one account is one person.
4. Plans and fees
- Basic is free: one agent, up to 100 leads a month, and a monthly allowance of AI processing. Leads past the limit are still stored, without the AI summary. We may change the limits or the plan with 30 days' notice by email.
- Pro and Premium are described on the pricing page and in your order. Fees are in Canadian dollars, plus GST, billed as your order says. Prices can change with 30 days' notice; a change applies from your next billing period.
- Texting, calls, e-signature and identity checks on hosted plans run on accounts you hold with those providers, at their rates.
5. Your data
- The leads, notes and settings in your account belong to you. You give us permission to store and process them only to run the service for you, as described in the privacy notice.
- You are responsible for collecting personal information lawfully: a real reason, clear consent, and respect for anyone who asks you to stop. MyHero records each consent line word for word so you can show it.
- You can export everything as a spreadsheet and delete any lead, or your whole account, at any time from the app.
- We may keep aggregated statistics that do not identify anyone.
6. Acceptable use
Do not use MyHero to send unsolicited messages, to contact people who have opted out, to collect information you are not allowed to hold, or to break any law, including Canada's anti-spam law and privacy law. Do not scrape, probe, overload or reverse-engineer the service, share one account between several people on Basic, resell access, or try to get around plan limits. We may suspend or close accounts that do, and we may refuse service to anyone.
7. AI-generated content
- Summaries, scores, drafts and other AI output are suggestions to save you time. Read them before you use them. They can be wrong.
- The AI is told never to state prices, availability, dates, or legal, tax or financial advice. If it does, that is not information from you, from a developer, or from us, and must not be relied on. What you send to a client is your decision and your responsibility.
- You remain responsible for complying with the rules of your profession and, for presale, with the Real Estate Development Marketing Act and the disclosure obligations that come with it.
8. Other people's services
MyHero uses providers to run: Cloudflare for hosting, Anthropic for the AI, Brevo for email, and Google or Apple for sign-in. Hosted plans also connect services in your own name, such as Twilio, DocuSeal and Stripe, which have their own terms. We are not responsible for those services, but we choose them with care and we will tell you if we change one that affects you.
9. Availability and support
We work to keep MyHero available and we fix problems quickly, but Basic comes with no uptime promise. Paid plans have the support and response commitments in your order. We may take the service down briefly for maintenance and we will try to do that outside business hours in the Pacific time zone.
10. Ending the agreement
- You can close your account at any time from the app. Export first if you want a copy; deletion cannot be undone.
- We can suspend or close an account for a breach of these terms, for non-payment, or if the law requires it. On Basic, we may close an account that has not been used for 12 months, after emailing you 30 days ahead.
- When an account closes, sections 5, 7, 11, 12, 13 and 14 continue to apply.
11. What we do not promise
MyHero is provided as it is. We do not promise that it will be error-free or uninterrupted, or that AI output will be accurate, complete or suitable for any particular purpose. Nothing in MyHero is legal, tax, financial or professional advice.
12. Limits on our liability
To the extent the law allows, our total liability to you for everything arising out of MyHero in any 12-month period is limited to the fees you paid us in that period, or CAD $100 if you paid none. We are not liable for indirect or consequential losses, lost profits, lost deals, or lost data that you could have exported. Nothing here limits liability that cannot be limited by law.
13. Your responsibility to us
You will cover us for claims, fines and reasonable legal costs that result from your breach of these terms, from the way you collect or use personal information, or from messages you send using MyHero.
14. Law and disputes
These terms are governed by the laws of British Columbia and the laws of Canada that apply there. Disputes go to the courts in Vancouver, British Columbia, unless we both agree to something else. If any part of these terms is found unenforceable, the rest still applies.
15. Changes and contact
We may update these terms. For changes that matter, we will email account holders at least 30 days before they take effect; continuing to use MyHero after that date means you accept them. Questions: hello@myherohq.com.
